Standing order terms and conditions

Standing orders

1.You will be allocated a Customer Account number to quote when corresponding with the Collectables and Solutions Centre.

2.If you wish to change your Standing Order requirements, you must notify us in writing at least three weeks prior to the release of a new stamp issue.

3.New Zealand customer orders will be dispatched by Standard Post and overseas customers’ orders will be dispatched by Air International unless requested otherwise.

4.New Zealand Post will collect and use the information set out in this form for the purpose in which it is provided. We will hold the information securely and will only use it in developing and running New Zealand Post and/or providing you with information about products and services that we think might be of interest to you. Under the Privacy Act, you are entitled to have access to, and to correct, your personal information at any time by phoning or writing to the Collectables and Solutions Centre, New Zealand Post Limited, Private Bag 3001, Wanganui 4541, New Zealand.

5.Your goods will not be dispatched until payment has cleared.

6.We are not obliged to accept your order to purchase New Zealand Post Stamps Business products or services.

7.We will not be liable to you for any delay or failure in meeting any order.

8.The Collectables and Solutions Centre reserves the right not to accept any Standing Order that does not meet these conditions.

9.Return of Products:  We will make every reasonable effort to supply your requirements. However, if you are not completely satisfied with your purchase, you may return it to us within 14 days of receiving it. At your option, we will replace the order or give you a refund.

10.Events outside our control:  We are not required to carry out any of our obligations referred to in these terms if it is not reasonably practicable for us to do so because of an event outside our control.

11.Indemnity:  You will indemnify us against any loss, damage, cost, claim or liability incurred by us arising from any breach by you of these terms and conditions.

12.Notices:  Any notice or other communication under these terms and conditions must be in writing addressed to us at the address set out below. A notice can be sent by hand, by pre-paid post or by facsimile to the relevant address.  Our address is:

13.Receipt of Invoice:  A notice of communication will be treated as having been received: 

  • when sent by hand, at the time of delivery unless it is delivered after 4pm on a working day, in which case the notice will be treated as having been received on the following working day; 

  • when sent by pre-paid post, working days after posting; and 

  • when sent by facsimile, on the day that it is sent unless it is sent on a day that is not a working day, in which case it will be treated as having been received on the next working day, in each case as evidenced by the facsimile confirmation.

14.Assignment: You may not assign any of your rights or obligations under these terms and conditions without our consent. We may assign any of our rights and obligations under these terms and conditions to a subsidiary of New Zealand Post Limited to the maximum extent permitted by law.

15.Interpretation:  In these terms and conditions, unless the context otherwise requires: 

  • references to clauses are references to clauses of these terms and conditions; 

  • words importing the singular include the plural and vice-versa; and

  • references to any legislation or document include all modifications, amendments and variations from time to time.

Definitions

In these terms and conditions, unless the context otherwise requires:

"Event outside our control"

means any event beyond our reasonable control including, without limitation, earthquake, cyclone, storm, flood, fire, disease, fog, snow, frost, other act of God, war, act by public enemy, civil commotion, loss of telecommunications or other utilities, strike, lockout or other industrial problem and any other general disruption;

"Balance"

means the available balance of your Customer Account in cleared funds from time to time;

"Standing order"

means a standing order that specifies your on-going New Zealand Post Stamp Business products or services requirements, pursuant to which we will endeavor to issue you, from each stamp or coin issue, those goods or services that meet your requirements until otherwise notified by you

"Working day"

means a day other than a Saturday or Sunday on which banks in Wellington are open for business;

"We" and "us"

means New Zealand Post Limited and includes any employee, agent, contractor or other person engaged by New Zealand Post Limited in connection with the issue of Customer Accounts and 'our' has a corresponding meaning; and

"You" and "yourself"

means any person to whom we have issued a Customer Account under these terms and conditions, and, where the context requires, means any of those persons jointly and severally, and 'your' has a corresponding meaning.
